1. Acceptance

By accessing myvitalitywellness.co.za ("the Site") you agree to these Terms of Use. If you do not agree, please do not use the Site.

3. Use of the Site

  • The Site is provided for information about our products.
  • You may not use the Site for any unlawful purpose, or in a way that damages, disables or impairs it.
  • You may not attempt to gain unauthorised access to any part of the Site, our servers or any connected database.

4. Waitlist and communications

When you submit your email to our Notify Me form you consent to receive launch and product-related emails from us. You may unsubscribe at any time via the link in any email or by contacting us.

5. Intellectual property

All content on the Site — including the Vitality Wellness™ name, logo, product designs, images, text and layout — is owned by or licensed to Vitality Concepts (Pty) Ltd and protected by South African and international intellectual-property laws. You may not reproduce, adapt or distribute it without our prior written consent.

6. Product information

Product descriptions, ingredients and imagery are provided for general information. Final product packaging, formulations and availability may differ. Our products are not medicines and are not intended to diagnose, treat, cure or prevent any disease.

7. Orders, prices and payment

Prices shown in our online store are in South African Rand and include VAT at the prevailing rate where applicable. Shipping is calculated and added at checkout. An order is only accepted once payment has been confirmed and we send you an order confirmation; if an item is unavailable or incorrectly priced we will contact you and refund you in full. Payments are processed by Payfast, a licensed third-party payment provider, over an encrypted connection. We do not receive or store your card details.

8. Delivery

We deliver within South Africa. Estimated delivery times are shown at checkout and are estimates, not guarantees. If we cannot deliver within 30 days of accepting your order, you may cancel and receive a full refund.

9. Cooling-off, cancellations and returns

Under section 44 of the Electronic Communications and Transactions Act, 2002 you may cancel an online order without reason and without penalty within 7 days of receiving the goods. Return the goods unused and in their original condition; we will refund the purchase price within 30 days. You are responsible for the cost of returning the goods.

Separately, under the Consumer Protection Act, 2008 you may return goods that are defective, unsafe or not as described within 6 months of delivery for a repair, replacement or refund, at your choice. To start a return, email info@myvitalitywellness.co.za with your order number.

10. Complaints and dispute resolution

Please contact us first at info@myvitalitywellness.co.za so we can resolve your complaint. If we cannot resolve it, you may refer the matter to the National Consumer Commission or the Consumer Goods and Services Ombud.

11. Disclaimer and liability

The Site is provided "as is". To the fullest extent permitted by law, Vitality Concepts (Pty) Ltd excludes liability for any indirect, incidental or consequential loss arising from your use of the Site. Nothing in these terms limits liability that cannot be limited under the Consumer Protection Act, 2008 or other applicable South African law.

12. Third-party links

The Site may link to third-party websites. We are not responsible for the content or practices of those sites.

13. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute is subject to the exclusive jurisdiction of the South African courts.
